General Terms and Conditions (PIRO Gaming GmbH in Austria)

1. scope of application

All business relations between PIRO Gaming GmbH under the business name ‘Gaming Room Schladming’, Hauptplatz 40, 8970 Schladming and the customer shall be governed exclusively by the following General Terms and Conditions (GTC).

Any other terms and conditions of the customer shall not become part of the contract, even if PIRO Gaming GmbH does not expressly object to them.

2. offers, ordering process, conclusion of contract, correction of input errors, storage of the contract text

2.1 Tickets and vouchers for the Gaming Room Schladming can be purchased via our website www.gaming-room.at, by telephone (+43 3687 25001) or during our opening hours in our business premises (prior registration required). Only persons of legal age are authorised to purchase.

2.2 The ticket and voucher offers in our webshop represent a non-binding invitation to order tickets or vouchers for the Gaming Room Schladming. By clicking the ‘Pay now’ button when booking a room or ‘Pay with PayPal’ / ‘Pay now’ when purchasing a voucher, the customer submits a legally binding offer to purchase the ticket or the vouchers in the shopping basket. Before submitting the order, the customer can view and change the data at any time. Required information is marked with an asterisk (*). The booking number automatically generated by us after the order has been sent documents that we have received your booking, but does not constitute acceptance of the customer's offer. The contract is only concluded with our declaration of acceptance, which is sent in a separate, further e-mail (booking confirmation including invoice). With the booking confirmation, the customer receives the ticket code that authorises access to the booked gaming area (Virtual Escape, Playstation, Nintendo, Gaming Lounge, etc.). In the event that the customer has ordered a voucher, the voucher code, which authorises the customer or the person to whom the customer passes on the voucher, to use the voucher amount as a means of payment when purchasing Gaming Room Schladming tickets, will be communicated to the customer in the booking confirmation email. Gaming Room Schladming reserves the right to pass on voucher sales to various partners (e.g. jollydays.at or R&S Online Sales and Marketing OÜ).

2.3 The customer must ensure that the e-mail address provided by him for order processing is correct and sufficiently configured (e.g. with regard to SPAM filters) and has sufficient free storage space.

2.4 The customer can correct input errors at any time during the order process by clicking on the fields that show the customer which phase of the order process they are in and navigating forwards or backwards in this way, or by pressing the ‘Back’ button in the browser.

2.5 The order text is not saved by us and can no longer be retrieved after the order process has been completed. The information from the order process will be sent to the customer again with the e-mail confirmation of the order. The customer can print out the order data immediately after sending the order.

3. prices, terms of payment

3.1 The prices quoted in our webshop include the statutory value added tax.

3.2 Payment for tickets and vouchers ordered in our webshop is made by credit card (VISA and Mastercard), instant bank transfer, PayPal or on site (cash or debit/credit card). We reserve the right to accept other payment methods in individual cases and to reject payment methods in individual cases.

a. payment by credit card
When paying by credit card (Visa and Mastercard), the data is transmitted to stripe using Secure Socket Layer (SSL) encryption technology. The purchase price is debited to the customer when the order is accepted. The transfer of data may take a few minutes and must not be interrupted by the customer, e.g. by refreshing the browser page. Otherwise the credit card account may be debited twice. We will refund justified refund requests within a maximum of 14 days from notification of the double booking by the customer. Any costs incurred as a result of chargebacks initiated by the customer will be passed on to the customer. A processing fee (usually EUR 10) will be charged for unjustified credit card chargebacks. This fee will be passed on to the customer accordingly.
Please note that if you choose to pay by credit card, payment may be made by you without a contract having already been concluded with us, as this only comes into effect upon receipt of our booking confirmation email (see section 2.2).

b. Zahlung per PayPal
PayPal is an online payment service provided by PayPal (Europe) S.à r.l. & Cie, S.C.A. The use of PayPal requires that you have a customer account with PayPal where your bank or credit card details are stored. If you have selected the payment method ‘PayPal’, you will be redirected to PayPal after completing the order. There you log in to your PayPal account with your e-mail address and the password you provided and confirm the payment. You will receive a payment confirmation from PayPal by e-mail. PayPal will debit your customer account with the corresponding purchase price and transfer it to our seller account. You can find more information at www.paypal.at.
Please note that in the case of the PayPal payment method, payment may be made by you without a contract having already been concluded with us, as this only comes into effect upon receipt of our booking confirmation email (see section 2.2).

4. right of cancellation

4.1 There is no right of cancellation for contracts for the provision of services in connection with leisure activities if the contract provides for a specific date or period for the provision of services. The purchase of tickets for the Gaming Room Schladming can therefore not be cancelled by the customer.

4.2 Otherwise the following applies:
If the customer is a natural person who concludes a legal transaction for a purpose that cannot be predominantly attributed to their commercial or independent professional activity (consumer), the customer has a right of cancellation. With regard to the requirements and legal consequences of the right of cancellation, please refer to the cancellation policy in the appendix.

5. booking conditions

5.1 Gaming Room Schladming is a gaming company for people aged 12 to 99. Children and young people who are not accompanied by a parent or guardian of legal age must present a declaration of consent signed by a parent or guardian without being asked to do so in order to participate in Virtual Escape missions.

5.2 Gaming Room Schladming is authorised to deny visitors access to the Gaming Room Schladming if it is feared that the person(s) concerned would disrupt general business operations or cause a nuisance to other visitors due to alcohol or drug consumption or for other reasons. The ticket price or voucher value will not be refunded in such cases.

5.3 Please note that Virtual Escape is a live event. As the Virtual Escape rooms are specially prepared for each booking and blocked for the booked period, it is your responsibility to arrive on time for the booked period. If you are late, PIRO Gaming GmbH reserves the right to refuse admission to the Virtual Escape mission in question. The ticket expires and there is no entitlement to a refund.

5.4 It is not permitted to bring your own food and drink.

5.5 It is not permitted to take bulky or dangerous objects, fireworks or other pyrotechnic items, weapons and dangerous tools, spray cans, noise instruments, laser pens, bottles, cans, intoxicants and animals - with the exception of those required to assist physically or mentally disabled persons.

5.6 With the exception of mobile phones, it is not permitted to take image, film or sound recording devices with you. Making sound, image or film recordings during the Virtual Escape missions or of the Virtual Escape rooms or transmitting or distributing such recordings in whole or in part via the Internet or other media (including mobile telephony) is only possible with the permission of the Gaming Room Schladming management.

5.7 Significant or repeated violations of laws or these terms and conditions may be penalised with an expulsion from the Gaming Room Schladming premises without reimbursement of the ticket price or voucher value and with a ban from the premises.

6. cancellations

6.1 You have the option of cancelling or rebooking the appointment free of charge up to 72 hours before the start of the game. A simple email to booking@gaming-room.at in Austria is sufficient for this. Cancellation by telephone is NOT possible.

6.2 If the cancellation deadline of 72 hours is not met, the customer is not entitled to a refund of the amount already paid.

7. changes in performance

Deviations in content and changes to the Virtual Escape missions after booking will only be made if necessary, provided they are not significant and do not significantly affect the overall content or effect of the booked mission.

8. sound, image and film recordings

8.1 Gaming Room Schladming is entitled to make sound, image and film recordings of the customer and his/her fellow players during the Virtual Escape missions, which are necessary for the execution of the game.

8.2 The customer agrees that specially created team photos or photos taken by employees of the Gaming Room Schladming during gaming sessions may be published and distributed online via the Gaming Room Schladming social media channels (Facebook, Twitter, YouTube, Google+). These images are only used for promotional purposes for the Gaming Room Schladming. Consent is given expressly waiving any claim to remuneration. The customer can revoke this consent at any time - at the latest, however, when the team photo is taken.

9. liability

In the event of impossibility and default as well as in the event of a breach of material contractual obligations, we shall also be liable for slight negligence, but then limited to the typical foreseeable damage. Essential contractual obligations (cardinal obligations) are those contractual obligations whose fulfilment is essential for the proper execution of the contract and on whose compliance the contractual partner regularly relies and may also rely. Typical, foreseeable damages are those which are subject to the protective purpose of the respective breached contractual standard. Otherwise, we shall not be liable for slight negligence. The above limitations of liability shall also apply to our executive bodies and vicarious agents.

10. Offsetting, contractual language, applicable law and place of jurisdiction

10.1 The customer is only entitled to offset if his claim is undisputed or has been legally established, unless it is a claim from the same contractual relationship. The customer shall only be entitled to a right of retention if his counterclaim is based on the same contractual relationship.

10.2 The contract shall be concluded in German. All disputes arising from the legal relationship between the customer and us shall be governed by Austrian law. In the case of consumers, this choice of law shall only apply insofar as the protection granted by mandatory provisions of the law of the country in which the consumer has his habitual residence is not withdrawn. The application of the UN Convention on Contracts for the International Sale of Goods is excluded.

10.3 The place of jurisdiction is the registered office of PIRO Gaming GmbH if the customer is a merchant, a legal entity under public law or a special fund under public law.

Cancellation policy

You have the right to cancel this contract within fourteen days without giving any reason.
The cancellation period is fourteen days from the date of conclusion of the contract. To exercise your right of cancellation, you must inform us at the following address

by means of a clear statement (e.g. a letter sent by post or e-mail) of your decision to cancel this contract. You can use the attached sample cancellation form, but this is not mandatory.
To meet the cancellation deadline, it is sufficient for you to send your notification of exercising your right of cancellation before the cancellation period expires.

Consequences of cancellation

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract.
For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment.
If you have requested that the services should commence during the cancellation period, you must pay us a reasonable amount corresponding to the proportion of the services already provided up to the time at which you inform us of the exercise of the right of cancellation with regard to this contract compared to the total scope of the services provided for in the contract.
